1. Purpose and Scope

1.1 This policy describes what products, services, and content may be listed, sold, or promoted on the Kapsule marketplace. It applies to all Sellers, listings, storefronts, product images, videos, descriptions, and communications on the Website.

1.2 These rules apply in addition to and together with our Conditions of Use, Privacy Policy, and Seller Policy & Code of Conduct.

1.3 This policy aims to protect Buyers, maintain marketplace integrity, ensure legal compliance, and promote a safe, trustworthy shopping environment for all users.

2. Acceptance of Terms

2.1 By listing, promoting, or selling products on Kapsule, you acknowledge that you have read, understood, and agree to comply fully with this Prohibited & Restricted Content Policy.

2.2 If you do not agree to comply with this policy, you must not list or promote items on Kapsule. Violations may result in content removal, withholding of funds, account suspension, or permanent account termination.

3. Kapsule’s Rights and Enforcement

3.1 This policy provides guidance but is not exhaustive. Products or content not explicitly mentioned may still be prohibited if they violate applicable laws, pose safety risks, or are inconsistent with Kapsule’s values and marketplace standards.

3.2 We reserve the right to determine, in our sole discretion, whether an item, listing, or content is acceptable under this policy. This includes the right to:

  • Remove, restrict, delist, or decline any listing or store without prior notice
  • Require modifications to listings, images, or descriptions
  • Request additional information or documentation at any time
  • Suspend or terminate Seller accounts for violations
  • Withhold payouts pending investigation of policy compliance

3.3 We may request supporting documentation such as:

  • Proof of origin, authenticity, or authorisation to sell
  • Business licenses, permits, or registrations
  • Safety certifications, test reports, or compliance certificates
  • Supplier invoices, receipts, or purchase orders
  • Intellectual property licenses or permissions

3.4 If you are unable or unwilling to provide requested documentation within a reasonable timeframe (typically 5 business days), we may remove listings, restrict your account, or terminate selling privileges.

4. Legal Compliance Obligations

4.1 Sellers must comply with all applicable New Zealand laws and regulations, including but not limited to:

  • Fair Trading Act 1986 (consumer protection, fair dealing, accurate representations)
  • Consumer Guarantees Act 1993 (product quality, fitness for purpose, safety)
  • Privacy Act 2020 (personal information handling and data protection)
  • Goods and Services Tax Act 1985 (GST registration and tax obligations)
  • Product Safety Standards under the Fair Trading Act (mandatory safety standards)
  • Food Act 2014 (food safety and hygiene requirements)
  • Medicines Act 1981 and Dietary Supplements Regulations 1985
  • Hazardous Substances and New Organisms Act 1996
  • Sale and Supply of Alcohol Act 2012
  • Unsolicited Electronic Messages Act 2007
  • Copyright Act 1994 and Trade Marks Act 2002

4.2 Some product categories listed below are allowed only with evidence of legal compliance. This may include:

  • Business registrations and licensing
  • Food safety programs and certificates
  • Product safety test reports
  • Regulatory approvals from government agencies
  • Proof of insurance coverage

4.3 Sellers are solely responsible for ensuring that all products listed comply with applicable laws, standards, and regulations. Kapsule does not verify compliance but may request evidence at any time.

5. Changes to This Policy

5.1 We may modify this Prohibited & Restricted Content Policy at any time to reflect changes in laws, regulations, marketplace standards, or business requirements.

5.2 Unless stated otherwise, changes take effect immediately when published on the Website.

5.3 Continued listing or selling on Kapsule after changes are posted constitutes your acceptance of the revised policy.

5.4 It is your responsibility to review this policy regularly and ensure ongoing compliance with all requirements.

6. General Eligibility Requirements

Product Standards

6.1 All products listed on Kapsule must be:

  • Lawful to sell in New Zealand
  • Safe for their intended use when used as directed
  • Accurately described in all material respects
  • Supplied from your stated business location in New Zealand
  • Available for dispatch within stated handling times
  • Compliant with all applicable safety standards, regulations, and product recalls
  • Genuine, authentic, and not counterfeit or stolen

Second-Hand and Used Items

6.2 Second-hand, used, pre-owned, refurbished, and open-box items MAY be sold on Kapsule provided they meet the following requirements:

  • Clearly and prominently described as “used,” “second-hand,” “pre-owned,” “refurbished,” or “open-box” in the title and description
  • Include clear, unedited photographs showing the actual item’s current condition, including any defects, wear, marks, or damage
  • Honestly and completely disclose all defects, damage, wear, missing components, functionality issues, and cosmetic imperfections
  • Comply with all applicable safety standards and are not subject to active safety recalls
  • Have been thoroughly cleaned, sanitised where appropriate, and are safe for their intended use
  • Include accurate information about age, previous use, service history, and remaining warranty (if applicable)
  • Are tested and verified to function as intended (for electronic, mechanical, or functional items)

6.3 The following used items remain PROHIBITED even with full disclosure due to safety, hygiene, or legal concerns:

  • Personal hygiene items that have been used (underwear, swimwear, cosmetics opened and used, toothbrushes, razors, hairbrushes)
  • Car seats, booster seats, and other child safety restraints unless accompanied by valid safety certification showing no prior accidents and compliance with current standards
  • Motorcycle helmets, bicycle helmets, and other safety helmets (unless certified unused with tags and packaging intact)
  • Cots, cribs, playpens, and baby sleeping products that do not meet current safety standards
  • Medical devices that require sterilisation (unless professionally sterilised with certification)
  • Mattresses and pillows (hygiene and bed bug concerns)
  • Opened or used food, beverages, supplements, vitamins, or health products
  • Prescription eyewear, contact lenses, hearing aids (medical device regulations)

Sourcing and Origin

6.4 Products must be sourced legitimately and ethically. Prohibited sourcing practices include:

  • Stolen, illegally obtained, or goods of suspicious origin
  • Items obtained through fraudulent means
  • Goods subject to outstanding finance, liens, or legal claims
  • Products imported in violation of customs or import regulations

6.5 Reselling goods sourced “as-is” from third-party online marketplaces (such as Temu, AliExpress, Alibaba, Shein, or Wish) without adding substantial value is prohibited. Components or materials from such sources may only be used where they are incorporated into original, new products that you manufacture, assemble, or substantially transform, and all safety and intellectual property requirements are met.

Dropshipping Prohibition

6.6 Dropshipped inventory and products dispatched directly from overseas suppliers or manufacturers to New Zealand customers are prohibited. All products must be:

  • Physically located in New Zealand at the time of listing
  • Inspected and verified by the Seller before listing
  • Dispatched from within New Zealand using New Zealand or locally-based courier services
  • Available for same-day or next-day dispatch (subject to stated handling times)

7. Prohibited Items and Content

The following items and content are strictly prohibited and may not be listed, sold, or promoted on Kapsule under any circumstances. This list is not exhaustive.

Adult and Sexual Content

7.1 Prohibited:

  • Pornography, sexually explicit images, videos, or materials
  • Adult toys, devices, or products intended for sexual use or enhancement
  • Sexual enhancement supplements, performance products, or aphrodisiacs
  • Adult services or experiences
  • Sexually suggestive content involving minors or appearing to involve minors

Animals and Animal Products

7.2 Prohibited:

  • Live animals, livestock, pets, or companion animals
  • Animal parts from dogs, cats, or endangered/protected species
  • Whole or intact animal parts (ivory, taxidermy, organs, bones from protected species)
  • Products made from endangered species listed under CITES
  • Animal fighting equipment or materials promoting animal cruelty

7.3 Allowed with restrictions:

  • Pet supplies, accessories, and toys (no live animals)
  • Ethically sourced leather, wool, feathers from non-endangered species
  • Responsibly sourced bone, horn, or shell products from non-endangered species

Veterinary and Animal Health

7.4 Prohibited:

  • Prescription veterinary medicines and controlled veterinary substances
  • Medical devices intended for use on animals requiring veterinary expertise
  • Veterinary diagnostic services or consultations
  • Products making unsubstantiated health claims for animals

Chemicals and Hazardous Materials

7.5 Prohibited:

  • Asbestos and asbestos-containing materials
  • Cyanide and highly toxic poisons
  • Strong acids, corrosives, and industrial chemicals
  • Explosive substances, fireworks, and pyrotechnics
  • Flammable liquids in large quantities (over 500ml)
  • Radioactive materials and substances
  • Restricted pesticides and agricultural chemicals

Dietary Supplements and Ingestibles

7.6 Prohibited:

  • Anabolic steroids and human growth hormones
  • Weight-loss supplements marketed as “fat burners” making unsubstantiated claims
  • Products containing ephedra, synephrine, or other banned stimulants
  • Supplements making therapeutic or medical claims without appropriate approvals
  • Unlicensed pharmaceutical products
  • Products marketed as alternatives to prescription medications

7.7 Allowed with restrictions and compliance evidence:

  • Dietary supplements complying with Dietary Supplements Regulations 1985
  • Vitamins and minerals with appropriate labeling and safety data
  • Herbal products with ingredient disclosure and safety information

Employment and Financial Services

7.8 Prohibited:

  • Job postings, employment listings, or recruitment services
  • Multi-level marketing (MLM) opportunities or network marketing schemes
  • “Get rich quick” schemes, work-from-home scams, or pyramid schemes
  • Financial services, insurance products, or investment opportunities
  • Mortgage brokerage or loan facilitation
  • KiwiSaver or retirement planning services
  • Cryptocurrency mining equipment marketed with profit guarantees

Medical, Healthcare, and Therapeutic Products

7.9 Prohibited:

  • Prescription medicines and controlled drugs
  • Contact lenses (prescription or cosmetic)
  • Prescription eyewear and optical devices
  • Home diagnostic test kits for medical conditions
  • Dermal fillers, Botox, and injectable cosmetic treatments
  • Used or opened cosmetics and personal care products
  • Breast pumps and lactation aids marketed as medical devices
  • First-aid kits marketed or labeled as medical devices
  • Products making unsubstantiated medical, therapeutic, or disease-prevention claims
  • CBD products and cannabis-derived products (regardless of THC content)

7.10 Allowed with appropriate disclaimers and compliance:

  • Over-the-counter medicines and remedies with proper labeling
  • General wellness products without medical claims
  • Cosmetics and personal care products (unopened, new condition)
  • Fitness and exercise equipment (non-medical)

No-Item-For-Sale Posts

7.11 Prohibited:

  • Donation requests or charity appeals
  • Memes, jokes, or humorous posts without actual products
  • News, awareness, or informational posts
  • Lost and found listings
  • Surveys, research requests, or data collection
  • Crowdfunding campaigns
  • Social media channels, YouTube channels, or blog promotions
  • Raffles, competitions, sweepstakes, or prize draws
  • Auctions or bidding systems (all items must have fixed prices)

Intellectual Property Infringement

7.12 Prohibited:

  • Counterfeit products, replicas, or knock-offs
  • Items infringing copyright, trade marks, patents, or design rights
  • Pirated media, software, games, or digital content
  • Unauthorised use of brand names, logos, or trade dress
  • Confusingly similar branding designed to mislead consumers
  • Products falsely suggesting affiliation with or endorsement by brands
  • Bootleg recordings, unofficial merchandise, or fan-made items using protected IP

7.13 You must own or have proper licenses for all intellectual property used in your listings, products, and marketing materials.

Tobacco, Vaping, and Smoking

7.14 Prohibited:

  • Cigarettes, cigars, tobacco, and tobacco products
  • Vaping devices, e-cigarettes, and vaping liquids (including nicotine-free)
  • Smoking paraphernalia (pipes, bongs, hookahs, shisha, rolling papers marketed for tobacco use)
  • Products marketed or designed to facilitate drug use

Weapons, Ammunition, and Dangerous Items

7.15 Prohibited:

  • Firearms, airguns, and replica firearms
  • Ammunition, cartridges, and projectiles
  • Explosives and explosive devices
  • Knives designed primarily as weapons (switchblades, butterfly knives, disguised knives)
  • Knuckle dusters, batons, tasers, pepper spray
  • High-powered laser pointers (over 1mW output) marketed as weapons
  • Novelty lighters designed to resemble weapons
  • Items marketed for self-defense or personal protection that could cause harm

7.16 Allowed with restrictions:

  • Kitchen knives, culinary knives, and cooking utensils
  • Camping and outdoor knives marketed for legitimate outdoor use
  • Collectible display knives sold as decorative items (clearly marked as non-functional or display-only)

Vehicles and Transportation

7.17 Prohibited:

  • Motor vehicles (cars, trucks, motorcycles, scooters) for sale or lease
  • Car dealership services or vehicle brokerage
  • Ride-sharing, taxi, or transportation service promotions
  • Vehicle rental or lease arrangements

7.18 Allowed:

  • Vehicle parts, accessories, and maintenance products
  • Automotive tools and equipment
  • Vehicle cleaning and detailing products

Real Estate and Property

7.19 Prohibited:

  • Real estate sales, property sales, or land sales
  • Rental property listings or lease arrangements
  • Timeshares and vacation ownership schemes
  • Event venues, halls, or facilities for hire
  • Mortgage brokerage or property financing

Spiritual, Metaphysical, and Alternative Services

7.20 Prohibited:

  • Psychic readings, fortune telling, or spiritual consultations
  • Reiki sessions, energy healing services, or similar practices
  • Raw crystals sold strictly “as-is” without incorporation into jewelry, art, or crafted products
  • Spell-casting services or magical rituals

7.21 Allowed:

  • Crystal jewelry, crystal products incorporated into art or decor
  • Books, guides, and educational materials about spiritual topics
  • Meditation aids, yoga accessories, and wellness products

Fitness and Weight Loss Services

7.22 Prohibited:

  • Gym memberships and fitness facility access
  • Personal training programs requiring in-person participation
  • Paid weight-loss challenges with entry fees
  • Body transformation competitions with monetary prizes
  • Diet coaching or nutritional counseling requiring professional qualifications

7.23 Allowed:

  • Fitness equipment and home exercise products
  • Workout guides, meal plans, and educational content (as digital or physical products)
  • Nutritional supplements complying with regulations
  • Yoga mats, exercise bands, and fitness accessories

Plants and Biological Materials

7.24 Prohibited:

  • Plants listed on the National Pest Plant Accord
  • Prohibited pests, organisms, or invasive species
  • Cannabis plants and seeds (regardless of legality under specific licensing)
  • Biosecurity risk items requiring import permits

8. Restricted Items – Allowed with Conditions

The following items may be listed ONLY if all specified conditions and legal requirements are met. Failure to meet these requirements will result in listing removal.

Alcohol

8.1 Allowed only if:

  • You hold a valid off-license or remote seller’s license under the Sale and Supply of Alcohol Act 2012
  • You can provide proof of licensing upon request
  • Age verification systems are in place (18+ only)
  • Products comply with labeling and advertising requirements
  • No delivery to minors or intoxicated persons

Food and Beverages

8.2 Allowed only if:

  • You are registered with your local council under the Food Act 2014 (if applicable to your food business type)
  • Products meet food safety and hygiene standards
  • All ingredients and allergens are clearly labeled
  • Packaging meets food safety requirements
  • Use-by dates and storage instructions are provided
  • Claims about health benefits are substantiated and compliant

Cosmetics and Personal Care

8.3 Allowed only if:

  • Products are new, unopened, and in original sealed packaging
  • Ingredients are listed in accordance with regulations
  • Safety assessments have been completed where required
  • No unsubstantiated therapeutic or medical claims
  • Expiry dates clearly visible

Children’s Products

8.4 All children’s products must:

  • Comply with mandatory safety standards
  • Include appropriate age warnings and safety information
  • Be free from toxic substances and choking hazards
  • Meet flammability and construction requirements
  • Not be subject to active safety recalls

Electronics and Electrical Items

8.5 Allowed only if:

  • Items comply with electrical safety standards (where applicable)
  • Products intended for New Zealand use have appropriate voltage (230V) and plug type
  • Battery-operated items include battery safety warnings
  • Devices with lithium batteries meet transport and safety regulations
  • No modified or tampered devices that could pose safety risks

Health and Wellness Products

8.6 Allowed only if:

  • No claims to diagnose, treat, cure, or prevent medical conditions
  • General wellness claims are substantiated with evidence
  • Products do not require therapeutic goods approval
  • Disclaimers are provided where appropriate

9. Consequences of Violations

9.1 Violations of this Prohibited & Restricted Content Policy may result in:

  • Immediate removal of listings without notice
  • Warnings and requirement to remove prohibited content
  • Temporary account restrictions or suspension
  • Permanent account termination for serious or repeated violations
  • Withholding of funds pending investigation
  • Reporting to law enforcement where illegal activity is suspected
  • Legal action to recover damages or costs

9.2 Serious violations include:

  • Sale of illegal, dangerous, or counterfeit goods
  • Fraud or intentional misrepresentation
  • Endangering health or safety of Buyers
  • Repeated violations after warnings

10. Reporting Prohibited Content

10.1 Users may report suspected prohibited or non-compliant listings through:

  • The “Report this listing” button on each product page
  • Email to support@kapsule.co.nz with details and evidence
  • The online reporting form at kapsule.co.nz/report

10.2 All reports are reviewed promptly, and appropriate action is taken where violations are confirmed.

10.3 We appreciate user reports as they help maintain marketplace safety and integrity.
