1. Purpose and scope
1.1 This policy describes what may be listed, sold, or promoted on Kapsule. It applies to all sellers, listings, storefronts, images, videos, descriptions, and messages on the Website.
1.2 These rules apply in addition to the Conditions of Use, Privacy Policy, and Seller Policy & Code of Conduct.
2. Acceptance of terms
2.1 By listing or promoting products on Kapsule you agree to comply with this policy.
2.2 If you do not agree, do not list or promote items on Kapsule. Breaches may result in content removal, withholding of funds, suspension, or permanent removal.
3. Our rights
3.1 This policy is a guide and not exhaustive. We may decide if an item or listing is acceptable and may remove, restrict, or decline any listing or store at our discretion without notice or liability.
3.2 We may ask for documentation (for example, proof of origin, licences, safety certifications, or invoices) and may delist or block items if documentation is not provided or is inadequate.
4. Compliance obligations
4.1 Sellers must comply with New Zealand law (including the Fair Trading Act 1986, Consumer Guarantees Act 1993, Privacy Act 2020, Goods and Services Tax Act 1985, product-safety regulations, food regulations, advertising standards, and any import/export and sanctions laws).
4.2 Some categories below are allowed only with evidence of compliance (for example, registrations, licences, SDOCs). We may ask for this at any time.
5. Changes
5.1 We may modify this policy at any time. Unless stated otherwise, changes take effect when published.
5.2 Continued use of Kapsule after changes constitutes acceptance of the revised policy.
6. General eligibility principles
6.1 Listings must be accurate, lawful, and safe; items must be supplied from your stated location with transparent delivery timeframes.
6.2 Second-hand/used items are generally prohibited unless they have been substantially upcycled, reconditioned, or repurposed into a new or original product (and are safe and compliant).
6.3 Reselling goods sourced from third-party marketplaces “as-is” (for example, Temu/AliExpress/Alibaba) is prohibited. Components from such sources may be used only where they are incorporated into a new/original product and all safety and IP laws are met.
7. Prohibited items and content (not exhaustive)
7.1 Adult products intended for sexual enhancement (for example, pornography and sexual enhancement supplements).
7.2 Live animals and livestock; pets; animal parts from dogs/cats or endangered species; whole or intact animal parts (for example, ivory, taxidermy, organs).
7.3 Medicines or medical devices for animals; veterinary services.
7.4 Hazardous materials and chemicals (for example, asbestos, cyanide, corrosives, flammables, explosive substances).
7.5 High-risk ingestible supplements: anabolic steroids, human growth hormones, weight-loss/“fat-burner” products, and products making therapeutic claims without approval.
7.6 Employment listings, recruitment, multi-level marketing, “get rich quick” schemes.
7.7 Medical and healthcare products/services including: contact lenses, prescription eyewear, diagnostic test kits, dermal fillers/Botox, used cosmetics, breast pumps, first-aid kits marketed as medical devices, products that make unsubstantiated medical claims.
7.8 “No item for sale” posts (donations, memes, news/awareness only, lost & found, surveys, crowdfunding, channels/blogs, raffles/auctions).
7.9 Intellectual property infringement: counterfeits, replicas, pirated media/software, unauthorised logo or trade-dress use, confusingly similar branding.
7.10 Tobacco, vaping, smoking paraphernalia (including pipes, bongs, hookah/shisha, e-cigarettes).
7.11 Weapons, ammunition, explosives; novelty lighters; laser pointers; knives designed primarily as weapons.
7.12 Vehicles for sale or lease, car dealerships, ride-sharing promotions.
7.13 Financial/insurance/KiwiSaver services and promotions.
7.14 Real estate sales/leases and venues for hire; mortgage brokerage.
7.15 Dropshipped inventory and distributor-shipped items (including products dispatched from overseas) and ambassador/affiliate-only promotions.
7.16 Spiritual/psychic services (for example, readings, Reiki services); raw crystals sold strictly “as-is” without transformation into a new/original product.
7.17 Gyms, personal-training programmes, and paid weight-loss challenges/services.
7.18 Plants listed on the National Pest Plant Accord; any prohibited pests or organisms.
8. Restricted items and conditions (allowed only if all conditions are met)
8.1 Alcohol
- Must comply with the Sale and Supply of Alcohol Act 2012 (appropriate licence where required).
 - Gift boxes including sealed alcohol are allowed only in accordance with licence and courier rules.
 - Accessories (for example, glasses, coolers) are allowed.
 
8.2 Ingestible supplements and foods
- Vitamins, collagen, herbal extracts/oils, protein powders, and similar products are allowed only where compliant with the Dietary Supplements Regulations/Food Standards Code and do not make prohibited therapeutic claims.
 - All foods must be produced under a registered premises, approved food control plan/risk management programme, and with compliant labelling.
 - Subscription meals/boxes and meat/butcher products require proper registration evidence.
 - “Just-add” kits and gift boxes containing pre-packaged foods are allowed with compliant labelling.
 
8.3 Items subject to product-safety standards
- Children’s products (for example, toys, sleep devices, restraints) must meet all applicable mandatory product-safety standards and include required warnings.
 - Any product that presents a choking hazard must comply with all applicable standards.
 
8.4 Electrical items
- Must be safe for NZ use; items requiring a Supplier Declaration of Conformity (SDOC) must have one; higher-risk items may require safety approval/certification.
 - NZ-compliant plug types only; items with foreign plugs are prohibited.
 
8.5 Animal-related products (not animals)
- Accessories, shampoos, collars, toys, and enclosures are allowed if safe and lawful.
 - Leather goods and fur/hide from lawful NZ domestic species (for example, possum) may be listed subject to law and ethical sourcing claims being truthful.
 
8.6 Cultural designs and language
- Products incorporating Māori or other indigenous/minority cultural designs, motifs, kupu, or translations must be created with respect and authenticity.
 - We may request details on collaboration, attribution, permissions/kainga kōrero, and reciprocity (for example, working with indigenous designers/kaimahi, appropriate remuneration, or kaupapa support).
 - Misappropriation or misleading cultural claims may result in removal.
 
8.7 Infant/child services and coaching/consulting
- Listings for coaching/consulting (for example, infant sleep, feeding, behaviour, life/wellbeing/nutrition/career) are restricted; relevant qualifications/registrations and clear disclaimers are required. We may request evidence and may remove services we consider unsafe or non-compliant.
 
8.8 Plants
- Indoor plants, succulents, terrariums, native trees, and fruit/vegetable seeds and plants are allowed if not listed on the National Pest Plant Accord and otherwise lawful to sell.
 
9. Examples of permitted items (if lawful and compliant)
9.1 Upcycled or reconditioned goods transformed into a new/original product (for example, furniture, apparel, jewellery).
9.2 Alcohol-related accessories and refurbished bottles used as craft (without IP infringement).
9.3 Lifestyle and fitness accessories (for example, watches) that do not make medical claims.
9.4 Culinary knives and utility knives used as tools (not marketed as weapons).
9.5 Animal enclosures and lawful accessories.
9.6 NZ-plug electrical items with required SDOC/safety certification.
10. Listing accuracy and claims
10.1 Do not make misleading, comparative, therapeutic, or unverifiable claims. All claims (for example, “organic”, “hypoallergenic”, “Made in NZ”) must be true and supported by evidence on request.
10.2 Use only content (text, images, logos) you own or are licensed to use.
10.3 Disclose material risks, age-restrictions, and mandatory warnings where required.
11. Intellectual property
11.1 Sellers must respect intellectual property rights, including copyright, trade marks, designs, patents, and rights of publicity.
11.2 You must not list or promote:
- Counterfeit, pirated, or replica products
 - Products that misuse another brand’s name, trade mark, or distinctive features
 - Works copied from protected designs, artworks, or creative content without permission
 - Infringing digital content such as pirated software, games, movies, or books
 
11.3 Sellers are responsible for ensuring they hold all necessary licences, permissions, or distribution rights to use any third-party content (such as stock images, logos, or designs).
11.4 Kapsule may request evidence of intellectual property ownership or licensing at any time. Listings without proof may be removed.
11.5 If you believe your intellectual property rights are infringed, you may submit a complaint with:
- Your contact details
 - A description of the work or rights you own
 - The specific URL(s) or listings you believe infringe your rights
 - Evidence of your ownership (such as registration certificates or proof of creation)
11.6 Kapsule will investigate IP complaints promptly, may remove or restrict the listing, and may share details with the Seller for resolution. Repeated infringement may result in suspension or permanent removal from Kapsule. 
12. Enforcement
12.1 We may remove or hide listings, place account restrictions, withhold payouts, cancel orders, or suspend/terminate accounts for any breach or risk to customer safety, legal compliance, or our reputation.
12.2 Repeated or serious breaches may result in permanent removal and notification to regulators or rights holders where required.
13. Reporting and appeals
13.1 To report content or listings or to ask compliance questions, contact Kapsule Support via the Website.
13.2 If your listing is removed, you may appeal by providing the requested documents and a clear explanation. We may uphold or reverse our decision at our discretion.
14. Sanctions, export, and customs
14.1 Sellers must ensure items and destinations comply with sanctions/export laws. International shipments may be inspected and may incur duties/taxes payable by the importer of record.
