This Kapsule Privacy Policy describes how One&Only Group Limited, trading as Kapsule (“Kapsule”, “we”, “us”, “our”), collects, processes, and protects your personal information through our websites, services, applications, and features that reference this Privacy Policy (together, the “Kapsule Services”).
1. What personal information we collect
1.1 We collect personal information in order to operate, provide, and improve Kapsule Services.
1.2 Information you provide to us: When you create an account, browse or save items, place an order, communicate with a Seller or Kapsule, submit a review, contact support, or participate in promotions. This may include your name, contact details, delivery addresses, payment method details (processed securely by our payment providers), communications, reviews, preferences, and any documents provided for verification. For Sellers this may also include legal name, business registration details, GST number, identity documents, and bank account information for payouts.
1.3 Automatic information: When you use Kapsule Services, we may collect device and browser type, IP address, operating system, app identifiers, clickstream data such as pages viewed and searches performed, session duration, error diagnostics, location information derived from IP, and information gathered using cookies and similar technologies.
1.4 Information from other sources: For example, updated delivery details from carriers, payment status from payment providers, fraud-prevention signals, and for Sellers, verification information from trusted service providers.
2. For what purposes we use personal information
2.1 We use your personal information to operate and improve the marketplace, including enabling transactions between Buyers and Sellers, processing orders, providing delivery details, acting as the Seller’s limited payments collection agent, and providing customer support.
2.2 We use it to deliver and improve Kapsule Services, analyse performance, troubleshoot errors, and develop new features.
2.3 We use it to prevent fraud and abuse, verify Sellers, and ensure platform security.
2.4 We use it to comply with legal obligations such as record-keeping, tax and GST requirements, and responding to lawful requests.
2.5 We use it to personalise your experience by recommending items, stores, and features that may be of interest.
2.6 We use it to communicate with you about orders, account matters, policy updates, and where permitted, marketing offers.
3. Cookies and tracking technologies
3.1 We use cookies, pixels, SDKs, and similar technologies (“cookies”) to operate and improve Kapsule Services. Cookies are small files stored on your browser or device that help us recognise you and remember your preferences.

4. Does Kapsule share your personal information?
We do not sell your personal information. We share it only as necessary to provide Kapsule Services. When you place an order, we share information with the relevant Seller so they can fulfil it, including items ordered, delivery address, and contact details. We share information with trusted third-party service providers such as payment processors, hosting and analytics providers, couriers, and customer support partners. We may share information with business partners or successors if our company is reorganised or acquired, subject to the same protections. We share information with authorities if required by law, to enforce our Conditions of Use, or to protect rights, property, or safety.
5. International transfers
Some service providers may be located outside New Zealand. Where personal information is transferred overseas, we take steps to ensure it is protected in a manner consistent with the Privacy Act 2020, such as contractual obligations requiring comparable safeguards.
6. How secure is your information?
We use technical, administrative, and physical safeguards to protect personal information. This includes encrypting data in transit, working with PCI DSS–compliant payment providers, and applying access controls to sensitive systems. We may ask for proof of identity before disclosing account information. You are responsible for protecting your password and logging out from shared devices.
7. Advertising and personalisation
We may use your personal information to display personalised recommendations and offers within Kapsule Services. We may allow third-party advertising providers to display relevant ads using cookies or device identifiers. We do not share information that directly identifies you for advertising purposes without your consent.
8. What information can you access?
Through your Kapsule account you can access and update your name, email address, phone number, and delivery addresses, your order history and saved items, your payment settings and preferences, your communication and marketing preferences, and your Seller account information if you are a vendor.
9. Your choices and rights
You may choose not to provide certain information, but this may limit your ability to use some Kapsule Services. You may update your account details in your profile, manage your communication preferences, and control cookies through your browser. You may request access to or correction of your personal information under the Privacy Act 2020 by contacting us. If you are a Seller, you can update or delete certain information in your Seller dashboard.
10. Children
Kapsule is not intended for use by children under 18. If you are under 18 you may only use Kapsule with the involvement of a parent or guardian.
11. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in law, technology, or our business practices. When we make material changes, we will post the updated version on this page with a revised “last updated” date. Your continued use of Kapsule Services after changes means you accept the updated Policy.
